Accident/Incident Investigation

Baker & O'Brien consultants are frequently retained as consulting or testifying experts for a wide range of accidents and incidents in the hydrocarbon process industries.  These may range from small accidents involving an injury, to serious accidents involving fatalities.  We have performed fire and explosion investigations, including those involving oil and gas processing, petrochemicals, the manufacturing of acoustic insulation, automotive paint systems, railcar explosions, and drilling rigs.  We have conducted cause and origin investigations and root cause analyses for our clients.  As part of our cause and origin investigations, and in support of potential litigation, we have been requested to secure and preserve the incident scene, coordinate the investigations of multiple third parties, including government agencies, and conduct on-site and off-site testing, as required.  Our investigation findings have been presented at court proceedings where our expert testimony has been relied upon by judges, juries, and arbitrators.

A tank explosion resulted from an overfill incident at a refined products terminal, which prompted claims by product suppliers for extensive business interruption losses.  At contest was the root cause of the tank overfill—whether equipment failure, operational error, inadequate maintenance, improper construction, or some combination.  Data analysis pertaining to these potential causes, including site visits to the terminal and monitoring system manufacturer, formed the basis of opinion of what happened and why. Is There Such a Thing as a “Foolproof” Process Design?
When a chemical company experienced a runaway catalytic reaction, the owner filed arbitration for damages it believed were caused by a design flaw with the emergency shutdown (ESD) system.  This case required Baker & O’Brien to investigate the root cause, the design and function of the ESD system, and operator competency.  Several expert reports were prepared and submitted as evidence in the arbitration, and we were cross-examined at the hearing. “Manifest error” is often described as an error as plain as the nose on one’s face.  In this case, the principle of manifest error pertains to disputed technical decisions made by the Independent Engineer (IE) for an oil refinery modernization project.  Three arbitral tribunals relied on our expert reports and testimony to decide if the IE had ruled correctly, within limits of its responsibility, and if there was manifest error. LPG Contamination in a Pipeline – Who’s to Blame?
Identifying the source of liquefied petroleum gas (LPG) contamination in a long-distance pipeline with numerous suppliers presents challenges.  A pipeline operator alleged that one supplier contaminated the product with heavy hydrocarbons, resulting in a two-month outage for maintenance and cleaning.  Expert opinion was based on the review of the nature of the contaminants, when they were observed, and concentration levels along the pipeline.  Read more
When a Refinery Joint Venture Ends in “Divorce” – What are the Assets Worth?
This refinery valuation was more complicated than typical.  When the joint venture relationship went sour, fair market value of the refinery had to be determined despite intemperate private block share transactions, skewed competitive market, and a lowly maintained facility.  After site visits and the review of relevant operational, maintenance, and financial information, we presented our value opinions in two expert reports and testified before the arbitration panel. Dispute Over a Flare Tip—What Constitutes Normal Wear and Tear?
An insurance claim was filed for damages to a flare when a sour gas plant experienced an unplanned shutdown caused by an electrical power interruption.  Baker & O’Brien was retained to assess whether damage to the flare tip was associated with the shutdown or was the result of wear and tear.  Our expert report, which considered the flare age, wind, and flame patterns during normal operation, and wear patterns on the welds near the tip, was submitted as part of the mediation process. An owner filed for arbitration against a contractor for lost profits resulting from a maintenance turnaround that extended beyond the planned completion date.  Baker & O'Brien reviewed the arguments by both parties and provided opinions on the productivity impacts, the reasonableness of damages claimed, and the quality of contractor work compared to industry standards. Our findings assisted the parties in settlement of the case during mediation, thus avoiding full arbitration. A chemical process plant that had been idled through severe winter weather was discovered upon inspection some months later, with damaged piping and equipment.  Baker & O’Brien was retained to review the detailed property loss insurance claim through analysis of equipment damages, interviews, examination of design, and operational and maintenance information.  Our expert report proved instrumental in the owner and insurance company reaching a settlement. When a compressor shut down and the blowdown valve was manually opened to relieve pressure, the sudden and catastrophic failure of a piping system injured a worker.  Root cause analysis was applied to identify from a myriad of potential causes, why this incident happened.  Baker & O’Brien considered the possible factors of people, equipment, policies, procedures, environment, and materials to draw conclusions presented in an expert report. A dispute between a refinery operator and an Engineering, Procurement, and Construction (EPC) contractor ensued when an overpressure relief system failed eight years into operation.  Baker & O'Brien assessed whether the cause was pressure relief valve inlet piping design or if deficiencies in operating procedures and maintenance practices were to blame.  We reported on the cause and also provided court room testimony regarding the EPC contract indemnification clauses. Equipment Condition: Was an Insurance Claim Inflated Because of Poor Mothballing Practices?
“Mothballing”—the practice of preserving and maintaining process equipment during an extended outage—can significantly impact the time and cost to resume operations.  An insurance dispute regarding repair costs following a plant explosion.  Baker & O'Brien identified which costs were directly attributable to the incident, and which may have been related to inadequate mothballing.  Our expert report addressed the adequacy of the mothballing and its influence on equipment condition at restart, and these effects on the amount of the claim.  Read more
Under Pressure—Crushed Like an Empty Beer Can
During the cleaning operation of a very large storage tank, the roof suddenly and unexpectedly collapsed; Baker & O’Brien was retained to determine why.  We evaluated the cleaning procedures, relevant valve positions, cleaning fluid temperatures, and then produced a computer simulation with these inputs to predict the forces that resulted in the tank damage.  Baker & O’Brien produced an expert report of the incident cause for the related claims for property damage and business interruption. As a result of a fire occurring at a refinery’s crude distillation unit, a refiner experienced a business interruption loss that led to a claim being submitted to its insurer.  To assess the loss, Baker & O’Brien considered the pre-incident operating plans to develop the “but for” operating case for calculating the business loss.  Our analysis and opinions were summarized in an expert report, which was used by the client in settlement negotiations. Know What's Below - Hidden Underground Hazards Can Strike Back
Ground disturbance and excavation are sure ways to uncover hidden underground hazards; however, it is far safer to establish the location of buried installations prior to opening an excavation.  After an excavation trencher struck an underground natural gas pipeline, the injured heavy equipment operator claimed the buried pipeline had not been properly identified and marked.  Baker & O’Brien reported on responsibilities for marking the pipeline, and which party had the regulatory compliance responsibility for safe execution of the work. Flare Systems and Hot Tapping - Understanding Risk is Essential
After an incident in which pyrophoric material was ignited in a flare header during a maintenance activity, a recommendation was to remove a suspected leaking valve to evaluate its integrity.  The flare system was still in live service; therefore, a hot-tap and stopple procedure would be required to isolate the pressure and hydrocarbon energy.  Baker & O’Brien was retained to inspect the site and submit an affidavit of opinion on the safety risk of performing the non-routine energy isolation procedure. Oilfield Incident - Multiple Parties - Who's at Fault?
When major maintenance, called a workover, is required on an oil and gas well there are often a number of well service contractors involved.  While the well was being prepared for its return to service after the workover activity was completed, an incorrectly positioned lock-screw was forcefully ejected from the wellhead.  After reviewing the evidence, we opined on the incident cause and the responsibilities of the entities involved at the well site. Refinery Flare Incident
Following a fire during a scheduled flare system maintenance turnaround, retained to assess the feasibility of safely hot tapping the flare header to install a stopple and allow removal of a large gate valve upstream of a flare knock-out drum.  In consultation with other parties, assessed: (1) the flare system equipment, (2) the refinery hot tap procedures, and (3) evaluated if the activities could be performed safely.

Investigated circumstances concerning personal injury of a contract employee who fell off a process vessel during a turnaround.  Investigation included evaluating:  (1) the operating company's and contractor's safe work practices; (2) relevant OSHA regulations; (3) appropriate fall protection requirements to mitigate risk associated with work activities; (4) responsibilities of affected parties and employees to utilize appropriate fall protection; and (5) identifying contributing factors to the incident.

Electrostatic Precipitator Explosion
Investigated the cause and origin of an explosion in an electrostatic precipitator used in a cement manufacturing plant that was the subject of an insurance claim.  Reviewed operating records for temperatures, pressures, and flow rates through a rotating cement kiln.  Evaluated operation of the electrostatic precipitator for anomalies prior to the explosion.  Concluded that the cause and orgin related to a mechanical failure in the kiln.  Provided findings to the owner and its insurer and supported decisions regarding coverage and subrogation issues.

Nitrogen Related Incident
Investigated events surrounding the rupture of a nitrogen vessel utilized to purge process equipment during a planned TA.  The rupture led to several employee injuries and a fatality.  Assisted counsel by evaluating existing plant safe work practices, procedures utilized by different parties associated with the event, and OSHA/PSM requirements relative to the job that was being performed.  Efforts included reviewing employee depositions, employee and contractor safe work practices, documentation related to the planned TA and incident, and OSHA regulations.  Developed expert report and provided deposition testimony.

Pipeline Operation Dispute
Following an unreported incident during right-of-way mowing, in which the machine downed a high voltage power line, the pipeline ruptured causing crude to seep into wetlands for several hours.  We were asked to opine on the following pipeline operational parameters: supervision of mowing crews, whether mowing is - or should be - a 'covered task,' actions/inactions of control room operators when starting and monitoring pumping operations and leak detection software.

Tank Collapse Dispute
Investigated the cause of a tank collapse that occurred during cleaning activities in preparation for a planned internal inspection.  Assessment included evaluating:  (1) condition of the tank prior to the incident; (2) work processes utilized by contractor performing tank cleaning; (3) maintenance and inspection practices of tank operator; (4) industry accepted practices for tank inspection; and (5) contributing causes that led to the incident.  Baker & O'Brien also assessed the cost to clean the tank and perform repairs following the incident.  Developed expert report and provided support through mediation and settlement efforts.
