Baker & O'Brien Releases Fourth Quarter 2017 Edition of Energy Expert: Issues in Focus

This quarter’s Energy Expert newsletter profiles several of Baker & O’Brien’s recent engagements that we hope you will find interesting and thought-provoking:
- In the lead article, Dave Morgan presents a case in which it was claimed that a postponed turnaround at a refinery was the cause of a catastrophic failure that resulted in a fire, injuries, and major equipment damage. Amongst other potential factors, the practices and programs that led to the decision to postpone the turnaround were reviewed as part of our assessment.
- Next, Kevin Waguespack presents a dispute between a refinery operator and a construction contractor following the discovery of oil outside of a diked tank area. Our work included determining whether each party followed applicable design and construction industry standards and best practices.
- Finally, Bill Jackson summarizes a hurricane-related insurance claim for a damaged sub-sea gas pipeline. Due to the urgency of the need to repair, several questions arose as to the schedule and costs.
